Here you will find the privacy statement of the 20X5 Challenge Foundation. 20X5 Challenge is the controller within the meaning of the GDPR. You are advised to read this privacy statement carefully before continuing on our website.

This privacy statement explains how the 20X5 Challenge Foundation handles your personal data. The 20X5 Challenge Foundation attaches great importance to good security of your personal data and wants to inform you about this as best as possible. This privacy statement indicates which (categories of) personal data of yours are processed and for what purpose this personal data is used. This privacy statement also states on what legal basis this personal data is processed and how you can exercise your rights with regard to your personal data.

The 20X5 Challenge Foundation reserves the right to change this privacy statement. The adjustment may be necessary due to new processing or to comply with the law. The 20X5 Challenge Foundation therefore advises you to consult this privacy statement regularly.

Privacy Policy

The 20X5 Challenge Foundation has a policy aimed at complying with the GDPR and respecting the privacy of interested parties, website visitors and project participants. The 20X5 Challenge Foundation does not only do this because it is legally obliged to do so. The 20X5 Challenge Foundation believes that privacy and careful handling of personal data are important because this is a personal right.

Personal data that we process

The 20X5 Challenge Foundation processes your personal data because you have contacted the 20X5 Challenge Foundation for information or because you participate in a 20X5 Challenge Foundation project.

Below you will find an overview of the personal data that the 20X5 Challenge Foundation may process: 

• first and last name; 

• address; 

• place of residence; 

• email address; 

• telephone number; 

• possibly your company name 

• team composition; 

• other personal data that you actively provide in the event of correspondence, telephone contact or in the context of participation in a 20X5 Challenge project.

The 20X5 Challenge Foundation does not intend to process personal data of children under the age of 16 without the consent of the legally representative parent(s). If you, as a legal representative, discover that we are processing data of your child(ren) without your consent, we request that you report this immediately viainfo@20x5challenge.nl

Purposes, legal grounds and term of processing personal data 

The 20X5 Challenge Foundation only processes personal data if there is a valid basis for doing so. Your personal data will be processed with your permission if you complete the contact form on this website or contact the 20X5 Challenge Foundation via e-mail, Social Media, WhatsApp or telephone for information or in the context of participation in a 20X5 Challenge Foundation project. Processing/storing this personal data is necessary to contact you in response to your question and to send information or to call you about a project of the 20X5 Challenge Foundation.

If you show interest in or have participated in a project of the 20X5 Challenge Foundation, the 20X5 Challenge Foundation has a legitimate interest in subsequently storing your personal data for sending information about the 20X5 Challenge Foundation. You can of course always ask the 20X5 Challenge Foundation to delete your data. See the section 'Your privacy rights'.

When participating in a project of the 20X5 Challenge Foundation, personal data that is necessary for carrying out the project is processed. You will receive a step-by-step plan for implementing the project. Some data will be kept in the administration for a maximum of seven (7) years after completion of the project, unless otherwise agreed in writing or a different period applies based on legislation.

With your permission, photos of you can be processed for marketing purposes. You can always withdraw this permission. Withdrawing consent has no consequences for the processing before the moment of withdrawal.

The 20X5 Challenge Foundation also stores personal data for which it is legally obliged to do so under (tax) legislation. This includes contracts or agreements, invoices, bank statements, correspondence, etc. The 20X5 Challenge Foundation must keep this information in its administration for seven (7) years.

Transfer to processors and third parties

Some personal data may be processed by companies engaged by the 20X5 Challenge Foundation or with which the 20X5 Challenge Foundation collaborates for the implementation of projects or the processing of administration. Such companies are also called 'processors'. These processors are located within the European Economic Area (EEA). The 20X5 Challenge Foundation concludes a processing agreement with these processors that meets the conditions of the General Data Protection Regulation so that the processing of your personal data takes place lawfully. The 20X5 Challenge Foundation remains responsible for the processing carried out by these companies on behalf of the 20X5 Challenge Foundation.

Your personal data will only be shared with third parties, other than processors engaged by Stichting 20X5 Challenge, if Stichting 20X5 Challenge is required to pass on personal data to competent authorities on the basis of a legal obligation. This could, for example, be the Tax Authorities or investigative authorities.

Security

The 20X5 Challenge Foundation has taken appropriate technical and organizational measures to protect your personal data against loss or unlawful processing. The website has an SSL certificate, which means that the data is sent encrypted via a secure connection. Frequent backups are made of the digital data. The board members of the 20X5 Challenge Foundation only have access to functionally related personal data. The processing takes place within the EEA. A processing agreement will be concluded with any processors.

Data leaks

Where work is done, mistakes can be made. The 20X5 Challenge Foundation will respond adequately to a discovered data breach. Depending on the type of data, the possible risks for the data subject(s) and the number of data subjects involved, the 20X5 Challenge Foundation will inform the data subject(s). In addition, the 20X5 Challenge Foundation will, based on these considerations, determine whether the data breach will be reported to the Dutch Data Protection Authority. All data leaks are registered in the data leak register.

The 20X5 Challenge Foundation uses functional cookies on its website. These are necessary for a good user experience of the website. The expiration of these cookies varies from the end of the session to a day at most.

Your privacy rights

Data that is no longer necessary will be deleted in accordance with the terms stated in this statement. Any permission you have given can be withdrawn by you at any time. Withdrawal of consent has no consequences for personal data already processed before the moment of withdrawal, but may affect participation in projects of the 20X5 Challenge Foundation.

The 20X5 Challenge Foundation will confirm receipt of your request and respond substantively to your request within four (4) weeks. To check whether the request is lawful, we will always ask you to identify yourself before you can use this. To this end, the 20X5 Challenge Foundation will contact you, preferably by telephone, and then use a number of specific questions to check whether your request is lawful.

The right of access only applies to your data. If your access threatens to violate the privacy of another person, the personal data of this other person will be deleted or made illegible. You will then receive a digitally cleaned copy of your data.

If you believe that your data is incorrect or incomplete, you can request that it be adjusted or supplemented.

You can request that your personal data be deleted. This may be the case, for example, if you believe that these are kept longer than necessary. If there is no basis for retaining your data, it will be deleted. Removal may result in any agreement with 20X5 Challenge no longer being able to be properly executed.

restriction or termination of processing 

You can request to limit or terminate the processing of your personal data. This may be necessary in the event of a legal action or if you believe that your data is being processed unlawfully by the 20X5 Challenge Foundation.

no profiling 

The 20X5 Challenge Foundation does not use your data for automated profiling.

If you want to file a complaint about the processing of your personal data by Stichting 20X5 Challenge, you can report this by sending an email with a description of your complaint toinfo@20x5challenge.nl

Responsible disclosure

If, despite the care with which the 20X5 Challenge Foundation processes personal data, you discover that this is not being done correctly, the 20X5 Challenge Foundation requests that you report this immediately viainfo@20x5challenge.nl 

The 20X5 Challenge Foundation will indemnify you from legal consequences, unless there is a deliberate attempt at hacking or another crime.
